The Law

While the Federal Government Senate vote on the House Bill to outlaw online betting is still pending, Washington has become the first State to outlaw online gambling. The bill submitted to the sent is known as SB 6613 and can be read on the Internet.

The bill was proposed by State Senator Margarita Prentice and the bill passed unanimously in the Senate and with just five dissenting votes in the House. It was signed into law by Gov. Christine Gregoire on March 28. It became effective on June 7, 2006. According to an Internet website, Senator Prentice has received numerous campaign contributions from land based casinos and they wonder if this may have had an influence on the introduction of the bill.

A Felony
What is disturbing about the Washington law is the fact that it not only makes online gambling illegal, it makes it a class C felony.

A Class C felony typically carry 5 year prison terms and $10,000 fines, the law’s sponsor says it will be an “unranked” felony. That means it has a maximum sentence of 1 year plus a fine. And if you’re a first time offender, you get no time or up to 90 days, plus a fine. The sponsor of the bill claim it was meant to protect the gamblers and not to punish them. (This sounds like a harsh case of protection to me.)

You Can’t Talk About It.
This website could be deemed illegal in Washing State. The legislation does more than ban online gambling. It also bans talking about online gambling—quite the communist move by legislators. The legislation specifically outlaws the passing of any "gambling information." Gambling information is defined as: information as to wagers, betting odds and changes in betting odds shall be presumed to be intended for use in professional gambling.

The Seattle Times reported that a local man from Bellington was forced to shut down his website which reviewed online casinos even though it did not accept any wagers. And the law does not pertain just to online websites. In a related story the Seattle Times also Reported that Washington State subscribers to Casino Player and Strictly Slots Magazines were informed by the publisher that it would not be delivering magazines to residents of the State.

Apparently the publisher of these magazines fear they may be in violation of the law since they publish advertisements for online casinos. If this isn't a violation of the First amendment, I don't know what is.
